I was thinking about this one a little bit and would like to hear what everyone thinks. The issue is the legality of downloading movies or TV shows from the internet. Let's say "Clerks" played on cable last night (on a non-premium channel), but I missed it and decided to download it. Since I pay for cable, and theoretically could have taped the movie the previous night so I wouldn't miss it, would downloading Clerks be illegal? I'm sure it would be, but this is an interesting one and I'd like to hear exactly why it's illegal. |

well, the reason networks essentially show things is to make money off its advertisers. for instance, if the superbowl didn't bring in so much revenue, then there wouldn't be the huge bidding war over who would carry it. by comedy central lets say, airing clerks, they are getting you, in theory, to watch ads from products x, y, and z, and get paid to show you that. so if you downloaded the movie a) it wouldn't be the comedy central edit probably, b) you wouldn't get the advertising, and since its "non-premium", they are losing the money of the ad companies, because you aren't watching their station. thats why the network would have the problem. as for legality, casette tapes you can tape off of TV on are not pristine in any way, but you could get a near perfect digital version of the film, and never need to buy a copy/watch it on TV again. thats why the recording industry was so up in arms about CD-Rs, b/c for the first time you could have a copy of something at the same quality it was meant to be heard at. i don't know if that answered anything, but thats what i think

it's illegal simply because whoever you're downloading it from doesn't have the rights to distribute the movie. they don't own it.. they didn't pay to distribute it.. it's blatant copyright infringement.
Comedy Central has the right to show it because they made a deal with Miramax or whoever.. and you have the right to watch it because you subscribe and pay for your cable service. neither of them really care if you make a shitty VHS copy of the movie.. what they do care about (at least the cable station) is the ad revenue, like broken face pointed out.
aquiring a copy (and a top quality digial copy) from someone who doesn't have the rights to distribute it is illegal.
now that we've established that.. where exactly can i find these free movies ?

Yeah, the laws are pretty clear.
But how do people feel? Is watching a downloaded movie really 'theft'?

Yes, Broken Face, I thought of the "losing money to advertisers" scenario...But what about movies that play commercial-free? Ahh well, I guess floop's argument is better. Best place to get movies are newsgroups, Kazaa, and eMule. |

movies that play commercial free usually are sponsored by someone, like "pepsi presents ________" - or premium services get your subscription dollars.

Yeah, but pretty soon we'll be moving into digital cable with digital recording...so we'll be able to tape nearly perfect quality shows. I think it boils down to renting video tapes. You can tape a movie off HBO at SP speed, which is nearly as good as a bought rental video, but you can't rent that same movie from the video store and make a copy of it.
Movie piracy is becoming a serious thing, I think mostly due to the DVD market. DVDs are now being marketed as being bought by people (rather than rented like Videos were mainly marketed for) mostly because lots of people don't buy many CDs any more, so they spend their pocket money on DVDs. "They" (big brother) don't want the same thing to happen to movies. It's strange because movies have always been something easily enjoyed by groups of people. I mean, the radio doesn't play full albums like TV does movies. And you can't really buy a CD and invite a bunch of people over and gather round to listen to it for 2 hours on a friday night. |

Gee...that would be a really cool idea actually.......
Why don't people have a 'music' night? Everyone goes to their favorite audiophiles place (so there's a truly awesome sound system [that isn't availble at Wal-mart]) and everyone brings CD's and you listen to the tunes.....
Shit, that would be kinda cool..
I guess one problem is that it's hard to get more than two people in the 'sweet spot'..
I think i'm gonna try and do this.....! |

isn't that kind of also what's known as a "party"..
i mean, usually if a group of my friends are at someones house, we're listening to something, so in a way, even though that wasn't the original intent of the get together, it's sort of already happening.. i mean, don't you guys play music and talk about it with your friends when you're hanging out?
i know what you mean though.. it could be fun to make it more official.. like, Saturday night, at so and so time, we're going to listen to The Clash (self-titled).. discussion to follow.. food and drinks provided. |

See, any party I've ever been to is hosted by people like Ricky Martin and the "top" 40 crew, much to my chagrin. I remember once I put in one song that I thought was good, just to save my sanity after an entire night of that crap, and it didn't even make it through the entire track, not to mention that I never heard the end of it. Kind of made me mad, cause I listened to their crap all night, and I put on something and it's off again in 45 seconds. Fair. |

I totally hear ya Dean. One of my friends actually likes BonJovi and I had to listen to it all the way from here to Kelowna. I put on a little Modest Mouse and she tells me to turn that shite off! I just shake my head. |

Ugh. See, on the other end of the spectrum, I went with Speedy_m to Portland/Seattle/Vancouver and we listened to FB/Pixies and a little John Williams/Breeders to space things out the entire way, and that was awesome. But if it had been Bon Jovi or whatever for more than two hours (much less 10) I would have booted him from the car... even though it was his. |

I don't know what it's like for you kids, but in our circle of friends musical taste is hard to come by. I once put on Pixies at work. The song playing at the time was River Eurphrates, which is, of course, glorious (It's Gloriuuuuuuus). And some shmo says "This is really terrible". This from a guy who likes Creed, 3 Doors Down, Third Eye Blind, etc. I mean, I'm no opera officianado. I know nothing about it. I like Carmen, the Phantom, les Miserables, etc. So if I hear an opera I don't like, I'll say "this isn't my cup of tea". But to insist that it sucks or isn't good, well, I just don't know enough to say if it's bad. Everyone is entitled to their opinion, but it's just that: an opinion. And they're often uninformed, especially with music because everyone fancies themself a music smart because they listen to the radio and they've heard all the "good" "artists". I think I'm done my rant now. Wait... okay now.
And Deano, nice work with Los Angeleez. I'll wait in the pouring sun. |

you guys need to make some new friends..
no, it's not like all my friends like the same music, but generally we have more in common than not. and most of my close friends are VERY close in taste to me..
Bon Jovi wouldn't be allowed in my CD player.. except to make fun of. which does have merit on its own as a listening practice. |
