When I came back to China from the UK last year the former manager of my school asked for all of my visa documents so that he could get them renewed. He took my foreign experts certificate, and green card and then gave them back to me 4 days later and told me that all was sorted and that I was good to live in China until August 2004. I took a look at my foreign experts certificate, checked the date and then put both of my documents in a safe place and forgot about them.
Towards the end of last week I picked up my green card and was browsing through it, when I realised that the expiry date was 31st August 2003. My manager had lied about the fact that he renewed it, and it means that I have been living illegally in China for 7 months, without even being aware of it.
My wife has phoned the bureau and they have informed her that there is a RMB500 per day charge for each day that I am in the country illegally... and seven months of that is RMB105,000 (about $13,000)... then my workplace were told that I will probably be arrested when I visit the government department to explain this huge fuck up.
My workplace are saying that they are not taking any responsibility, despite the fact that it was their responsibility to correctly renew my documents. So things are looking very bizarre indeed. Has anyone ever been in this kind of situation? The weird thing is that since August 31st, I have flown 3-4 times internally in China and have also got married (which required me to submit my documents to the Chinese authorities)... and no-one has pulled me over about this.
Man, it's fucked up because I have done nothing wrong other than be naive enough to trust my manager when he told me that everything had been sorted out.... and now I face possible arrest, plus a fine. A few friends have said that I won't have to cough up the full RMB105,000 as when the charge hits RMB5,000 it gets capped... but these are not official sources, so I am a little anxious.
Also, maybe as I was here illegally in January then my marriage to my wife could possibly be annulled.... which would be even weirder.
Any suggestions? I guess first thing is that I should go to the embassy and see what they suggest... Man why was I so stupid... this is classical Chinese behaviour, people here are compulsive liars and I was naive enough to think that my boss was a trustworthy character.

Oh... and this also fucks up my chances of going back to the UK to see Pixies. If I have to pay a fine then that will destroy my plans of seeing my favorite band.... unless of course they deport me.

I am counting on that Dave, I'm hoping that they'll see that I am married and be lenient... and with my papers being in a mess, they'll realise that the twat boss didn't know what the fuck he was doing (that part is not my fault). Fuck, it's all a bit up in the air... so I don't know what is going on.... thats the worst part.
At the end of the day why would I risk taking internal flights, and getting married if I consciously knew that I was here illegally.
Do you reckon prisoners have internet access?

What part of China are you working in, near Beijing?? The only thing that you should be aware of is to get your company to sort your visa out, and do it properly.... make sure you check it out yourself. You'll find that alot of people here seem to have Olympic gold medals in lying and cheating people, but at the same time there are decent folk out here (it really does seem that there are alot of cheats out here though).
Its a decent quality of life out here, but you do have to put up with people being very ignorant, and seeing people behave in very strange ways (loudly hocking up greenies and spitting in the streets / restaurants / on buses etc, alot of people staring you out, pushing in on queues, people randomly yelling 'hello' at you in the streets).
I loved it here when I first came, but after a while the above gets on your nerves. Maybe I just need to move to a different country, maybe not the UK, maybe Australia for a year....

sorry to hear all that stuart! sounds like a tricky one. no suggestions here i'm afraid, just what you said, check in at the embassy... failing any help there is there any free legal advice services or any kind of citizens advice beareu (or however you spell it!) over there?

This is completely fucked up. I would be sooooo mad if that happened to me (I guess you probably are).
The only thing I can suggest is move to Australia. The people there are the best. Great country.

Man I am still steaming with rage, this has to be the most unhappy I have been for a long time, and it's only 3 months since I got married. Really, I should just think that I really haven't done anything wrong, other than be a trifle naive, and just forget about it. It's hard to forget about it though when I know that I'll have to cop the fine and I will miss out on seeing the Pixies. Ive waited 5 fucking years to see Pixies, and just when it looked certain I get fucked over.
The Embassy dudes have emailed me back and they want my employers phone number, so with any luck they will make a nasty phone call and try and shit them up a bit (as I am sure that the Embassy can report these guys to the Government).
I have actually been informed that if I go to the Public Security Bureau to sort this out then I will arrested.... however, first I am going to speak some more to the embassy and wait a few days to see if the wifes contacts can bail me out. The one good thing to come out of this is the way the wife has reacted to this, she's been fucking gold and is really doing as much as she can to prevent me from getting fisted by the red army.

Hi Stuart, I found myself in a similar kind of situation in Israel but when it became apparent to them that I had proof to back up my story (that i wasn't working on the black-market) they backed off and everything was resolved amicably...I'm sure you'll be ok dude.

Thanks a lot Stuart! That's a mighty kind offer and I just might take you up on it; it would be cool to meet someone from the forum. Only thing is I don't drink. Believe me, as an Irishman I know the offense some take at that, but I mean no offense. I've heard the Chinese get awfully bent out of shape when you refuse to drink with them too. Is that true?

Saying that, not all people out here are unbareably annoying, there are some really nice people, but they seem to be overshadowed by the large number of tossers, there really are alot of them here (and they always seem to be the managers at the schools).

Cheers Mel... tomorrow I'll find out. The people at the PSB want me to go to their office tomorrow, but the wife has advised me against it as they might try and arrest me. So, she is going to go there and try and sort it out, if it cannot be sorted I will go there and take whatever they are going to throw at me. I think as long as they see money then they will not do anything drastic.
Its got to a point where I really don't give a fuck now, saying that I am filled with dread at the prospect of sharing a cell with a man hungry mongolian serial killer. I am also a little bewildered at the attitude of my employers who are still claiming that this is nothing to do with them.

Today is the day this gets solved, or I get fucked..... there can be only one thing to do.... listen to The Crue before going to work and get prepared for a 'Big Vern' (Viz character) style showdown.

Good news, all is sorted.... there is no chance that I'll get my arse filled in in Jail. Had to pay a 350 quid fine which is a right pisser, but thats better than having to leave the country, or getting fined the full whack. Still, I'm pissed off as work will not accept responsibility and pay anything towards the fine, which means that I will not be going back to the UK to see Pixies.
