Ok folks any advice/help on this would be very nice and appreciated.

Me and a friend are making a film for our final year in the University of Glamorgan, in the UK. We're making a film about three films, Eraserhead, Un Chien Andalou and The Seventh Seal. Our film is a comedy based around one mans struggle to understand these films, as he visits characters from each of the films, Death, the Lady in the Radiator, and the woman whose eye is cut open in Chien Andalou.

Anyway our problem lies in music rights. Obviously the Pixies recorded a cover of in Heaven Everything is Fine and Debaser is inspired by Un Chien Andalou. We've also got a nice Monkey Gone To Heaven line in there. Basically we want to use Debaser, In Heaven Everything is fine, Monkey Gone To Heaven and perhaps Oh My Golly on the film itself.

I've contacted the 4ad website and I can't make any sense of the licensing request forms. What we want is to enter the film into two student festivals, essentially this means the film won't be making any money as they are non-commercial festivals. Some record companies have a problem with this, others don't, e.g. Pavement gave us permission to use a song via e-mail as long as we didn't make any money.

So in a very roundabout way i'm asking people if there is anyway i can contact 4AD and actually plead our case, the forms don't really have anywhere for us to say "hey, we're not making any money on this at all". Obviously people need to earn a living from the licensing of songs and if we do enter it into a commercial festival we will of course apply for the relevant license and we will gladly pay the fee.

Also whats the case with cover songs? I think there may have been a Pixies Tribute album composed by the good people of this site or was i just dreaming? If i wanted to use a cover instead would that be a) cheaper, b) easier or c) not allowed?

So if anyone made any sense of the above please respond with your advice/suggestions? I've contacted 4ad numerous times with no luck, so i'm thinking at the momeny that cover versions would be easier to handle.

Thanks for the help. Jo doesn't appear to have any kind of send e-mail type icon so i'll just have to wait until she reads this. I've just e-mailed Cooking Vinyl who released the Purple Tape in the hope of getting permission to use In Heaven Everything Is Fine.

Just incase 4AD refuse to let me use the songs can anyone give me the names of some bands, if any who have covered the following songs:

Debaser
Oh My Golly
Monkey Gone To Heaven
In Heaven Everything is Fine
Velouria

My band, the cut*off, covered monkey gone to heaven on the tribute album. You are welcome to use our cover, it is a pretty straight forward cover so it sound a lot like the original. That was our intentions considering we did not want to distort the pixies brillant song and plus our music is influenced by the pixies which made it easy for us to cover their song.

I'm not sure where the music rights lay on a cover tune considering we did not write the song, all we did was perform it but, if it is a non-profit film I don't see a problem. You get the okay from me to use the song. Anyone else know the Music rights on a recorded Cover Song? I just discovered the Pixies tribute album and i'm very impressed. Thank you for the offer blue cadet3, we may take you up on that offer. I've been downloading some of the songs, and even though the editing process is still a while off we really want to get this music rights issue sorted out. I'm sending off the request forms to 4ad this week, practically begging them to let us use the songs. Obviously, and I mean this as no insult to anyone who worked on the tribute album but we really want the original songs. However thats the next place we're going to look if 4ad turn us down. I'll ask them what the policy cover songs are. As far as i'm aware the person who wrote the song controls it, the record company only owns the recording of it, so I guess i'd have to get permission from your band(s) and Frank Black.

Well the quest goes on, thanks again for the offer blue cadet3 i'll check your site out and keep you posted on developments.

Good luck on your search. The idea for your film is great. I understand you want the original songs no offense is taken but if you need the cover you are welcome to it. Keep us posted on your findings and the film.

best thing, fill out as much of the forms as you can, I'll speak to someone tomorrow (I wont be able to help though, I have to make this clear, I have nothing to do with licensing!) but I think as long as they have all the relevant information, it'll help them make their decision

Thanks a lot. I understand you won't be able to help me out but thanks for the info. I've also learned now i have to contact the Mechanical Copyright Protection Society to get clearence from the publishers too. If 4ad refuse permission I still have to ask the MCPS for help in getting permission to use a cover of the song. So lots of e-mails and phonecalls ahead for me.

Just a quick update for those of you who care/don't care. I sent the request form to 4ad Sunday and I had an e-mail reply today. I'm not certain but i think they might allow me to use the songs. They did want to know what festivals i wanted to enter the film into so we'll wait on news from that.

I was also told to contact Ken Goes who I believe was/is the former Pixies manager? to get permission from the publishers, Rice N Beans music?

Anyway I now await news from Ken Goes and 4ad about the festivals and whether I will have to pay a sum of money for permission. I'd say right now there is a 40/60 chance that we'll get permission. No news from Cooking Vinyl yet on In Heaven Everything is Fine though.
